Illinois State Flag – CBD legality?

YES! Well sort of. Technically YES CBD is LEGAL in Illinois. CBD is legal as long as it contains less than 0.03% THC but it’s complicated. Is CBD Legal in Illinois? I had to ask myself this question before venturing into the CBD business being located in the great Windy City myself.  A quick Google search returned these results:

Congress is now is considering the 2018 Farm Bill, which would legalize industrial hemp across the country. … Illinois is among 37 states that have legalizedmarijuana-based CBD for medical use, while nine other states have fully legalizedpot and its derivatives.Sep 19, 2018

Well ? Its November 29th 2018 and this data was over 2 months old. Has anything changed in regards to CBD legal standing in Illinois? So another google search ” Is CBD Legal in Illinois Nov. 2018″ I found this article at 

According to the 2014 Farm Bill, a set of federal laws concerning US food and agriculture, legal “industrial hemp” refers to plants and products derived from cannabis plants with less than 0.3% THC, grown by a state-licensed farmer. There’s nothing in the bill about CBD, and the hemp industry makes many of the CBD products now widely available.

The commonly held belief is that if you’re consuming products made from hemp grown by a state-licensed grower, that contains less than 0.3% THC, you’re in good shape. If you live in a city like New York, and have noticed coffee shops selling CBD lattes and the like, there’s a good chance they fall in this category.

“We’re in this stage where we have non-enforcement at the federal level, non-enforcement at the state level,” says Cristina Buccola, a New York-based attorney who advises cannabis-related businesses. “For all intents and purposes it looks like a legal substance.”

So according to the “2014 Farm Bill” industrial hemp with less than 0.3% THC grown by a licensed farmer is LEGAL. 

HOWEVER, this same article also says this:

“Regardless of how states voted, marijuana is still federally outlawed as a Schedule I substance, which the US Drug Enforcement Administration (DEA) states have “no currently accepted medical use and a high potential for abuse” (despite, in marijuana’s case, evidence to the contrary).

Effective in January 2017, the DEA ruled that marijuana scheduling includes “marihuana extract” (the agency typically refers to marijuana either by the plant’s scientific name, Cannabis sativa, or the Reefer Madness-era spelling “marihuana”). In the rule, the agency defined “marihuana extract” as an “extract containing one or more cannabinoids that has been derived from any plant of the genus Cannabis”—which would include CBD

OKAY! SO THIS IS CONFUSING! CBD is an “marihuana extract” (marihuana, say it how it’s spelled, lol, so mari-hu-ana , sounds like the name to a mexican love song. ) Anyways…..

According to these conflicting laws I have concluded that this is how the CBD industry works presently 11/29/2018 –  CBD laws are a set of laws that the federal policing sector are not willing to devote resources to, assuming the CBD products sold are THC free (Less than 0.03%)  and acquired through proper channels.  This then slides the puck to the State and local level of government to determine how they want to handle CBD laws in their own jurisdiction. 

CBD IS ILLEGAL in Nebraska & Idaho!! 

-If you are in these 2 states CBD is definitely illegal – Nebraska & Idaho. If you are buying/selling CBD in these states you should definitely tread with caution!  

CBD WAS Illegal in Kansas & Dakota up until recent industrial hemp pilot programs!

South Dakota & Kansas were in the above forbidden fruit category up until a few months ago where a industrial pilot program has begun.

Illinois CBD Legal Status – IS CBD Legal in Illinois?

YES! Illinois has an industrial hemp program which specifically allows manufacturers to extract CBD.

In 2018, the state signed into law SB 2772, the Commercial Low THC Hemp Extract Act. This law makes it legal to distribute or sell low THC hemp extract if they can provide a certificate of analysis showing that it contains no more than 0.3% total THC by weight. The law also amends the Cannabis Control Act to exclude low-THC hemp extract from the definition of “cannabis”.

My research into the legal status of CBD has been confusing and conflicting to say the least.  I have come the the conclusion that it is of most importance when acquiring CBD to be certain you are buying your products from a reputable licensed cbd processing company or supplier. 

For those of us living in Illinois we are fortunate to not have to stress about the legality of consuming CBD products in our great state. CBD is changing lives across the world for the better and helping people with a multitude of conditions, illness, symptoms, side-effects, and over-all quality of life. I personally started as a skeptic and have converted to a faithful believer of CBD’s health benefits after seeing them first hand with my own eyes.  I pray for continued change and awareness and look forward to our future! A future where nationwide CBD is understood and accepted for what it really is – a natural medicine that works.
